Before you pay

How to check a travel agency licence before paying

A friend sent you a good-looking Muslim tour poster, and you want to know it is real.

Ask the seller for their MOTAC licence details in writing, then confirm them with MOTAC before you pay a deposit. A licence does not tell you whether the food is halal. It tells you whether the seller is allowed to sell tourism services at all, and whether there is a regulator to go to if something goes wrong.

Who regulates travel sellers in Malaysia?

MOTAC states that it is the government agency that enforces the Tourism Industry Act 1992 and its regulations1. Running a tourism business without a valid licence can lead to a fine of up to RM500,000, imprisonment of up to ten years, or both2. That is a serious offence, which is why the licence check is worth five minutes.

MOTAC tells providers of transport, accommodation or tour services, offline or online, to apply for a licence at the nearest state MOTAC office3. So an online seller is not exempt because there is no shopfront.

What do I ask the seller?

Copy this message and send it before you discuss price.

  • “Please send me your company name, your MOTAC licence number and the licence expiry date.”
  • “Is the name on the licence the same as the name on the invoice and the bank account I will pay?”
  • “Which tour operator will run the trip, and are they licensed too?”

A licensed seller answers in one message. Hesitation, a request to talk on the phone instead, or a screenshot you cannot read are all signals to slow down.

How do I confirm what they send me?

Do not rely on a photo the seller sends. A licence image can be old, edited or borrowed from another company. Confirm the licence number and company name with MOTAC through its official website or the nearest state MOTAC office. If MOTAC cannot match the details, treat the seller as unconfirmed.

Under normal conditions, a MOTAC company licence for a tour operator involves a premises inspection4. A real company therefore has a real address. Ask where the office is and whether you can visit.

What are the signs of an unlicensed seller?

  • No company name on the poster, only a first name and a phone number.
  • Payment requested to a personal account, or to a name that does not match the company.
  • A licence number that is “pending” or “in process”.
  • The deal is only available today, and the deposit must move now.
  • Refusal to put the itinerary, meals and cancellation terms in writing.

One sign is a reason to ask more. Three signs together are a reason to walk away.

What should I do if I think a seller is unlicensed?

Do not pay. If you have already paid, stop further payments and keep every message, receipt and screenshot. MOTAC invites the public to report suspected tourism rule violations through its SISPAA complaints system5. Check the MOTAC website for the current address before you file.

What does a licence not cover?

It does not cover halal, prayer arrangements, or whether your elderly parents can manage the pace. For those, use our questions to ask a tour operator about halal meals and the guide on what to confirm in writing.

Your next step

Send the three-line message above to every seller on your shortlist. Then compare the licensed ones with the Muslim-tour inclusion comparator. The booking hub has the rest of the pre-payment checks, and choosing a first overseas holiday helps if this is your first trip abroad.

If a seller has sent you a poster or quote and you are not sure about it, send us the details and we will walk through the checks with you before you pay anything.

Common questions

Why does a travel licence matter for a Muslim tour?

A licence shows the seller is registered with the government agency that regulates tourism, so there is somewhere to complain if things go wrong. It says nothing about halal. It is the first check, and the halal and prayer questions come after it.

Can I trust a seller who only sells through Facebook or Instagram?

A social media page can belong to a licensed company, so the platform is not the problem. The problem is a page with no company name, no licence details and a personal account for payment. Ask for the licence details in writing and check them before you transfer anything.

What if the agency says the licence is being renewed?

Ask for the licence number and the expiry date in writing, and confirm them with MOTAC before paying. A genuine renewal in progress still leaves a clear record. If the seller cannot show one, treat the licence as unconfirmed and do not pay a deposit.

Is a licensed agency automatically good at halal and prayer planning?

No. A licence is about legal permission to sell tourism services. Whether the agency understands your halal and prayer needs is a separate test. Use our questions for tour operators on halal meals and the written-confirmation checklist.

Where do I report a seller I think is unlicensed?

MOTAC invites the public to report suspected tourism rule violations through its SISPAA complaints system. Gather screenshots of the offer, the seller's details and any payment receipt first. Check the MOTAC website for the current address before you file.

My parents booked through a relative who runs trips on the side. Is that safe?

It depends on whether the relative holds a licence. Family trust is real, but a licence is what protects your parents if a flight or hotel falls through. Ask politely for the licence details, the same as you would of any seller, and keep a written copy.
