Who is responsible when a promise is missed?
The halal lunch did not arrive, and nobody can tell you whose job it was.
Your first contact for a missed promise is the seller who took your money, because that is who your contract is with. The restaurant, driver and guide are further down the chain and only know what they were told. Knowing the chain before you pay tells you where to send a message when something goes wrong.
What does the chain look like?
A Muslim-friendly trip passes through three layers.
- The seller you paid. A travel agency, an online platform or a tour operator. This is the party with your contract and your receipt.
- The operator who runs the tour. Sometimes the same company as the seller, sometimes a different one in Malaysia or abroad.
- The local suppliers. The hotel, the restaurant, the coach driver, the guide, the prayer-room venue.
A promise made in the first layer has to travel down to the third. Each hand-over is a chance for “halal lunch” to turn into “lunch”.
Who do I approach for which problem?
| Problem | First contact | Why |
|---|---|---|
| Halal meal not as promised | Seller you paid | Your contract names the meal, the supplier does not |
| No stop for Zohor or Asar | Guide on the day, then seller | The guide can adjust the route, the seller owns the promise |
| Wrong room type | Hotel desk, then seller | The hotel can swap rooms, the seller owns the booking |
| Refund or compensation | Seller you paid | Money moves back along the same path it came |
| Seller will not reply | MOTAC complaints route | See below |
How do I word a complaint so it gets fixed?
Keep it short and make it easy to act on. Four lines are enough.
- “On [date] your quotation said: [copy the exact promise].”
- “On the day: [what happened, with one photo or message].”
- “I raised it with [guide or hotel] at [time] and they said: [their answer].”
- “I would like: [refund of the meal portion, a replacement meal, or a credit].”
Send it on the same day, by message, so there is a dated record. Copy-paste the promise instead of describing it from memory.
What makes the chain shorter?
The best protection is a written promise that already names the supplier. Ask the seller to confirm which restaurants, which hotel and which transport company will carry out your arrangements. Then ask whether your halal and prayer notes have been passed to them. Our guide on which dietary and prayer arrangements to confirm in writing lists what to put in that message.
For a group, the organiser carries extra weight. The group organiser’s checklist explains how to hold one set of confirmations for everyone.
What if the seller does not respond?
MOTAC states that it is the government agency that enforces the Tourism Industry Act 1992 and its regulations1. It also invites the public to report suspected violations through its SISPAA complaints system2. Check the MOTAC website for the current address before you file.
It is far easier to check the seller’s licence before you pay than to chase an unlicensed seller afterwards.
Your next step
Put your two quotes side by side with the Muslim-tour inclusion comparator and write beside each line who would be responsible for it. Where a line has no name beside it, ask the seller before you pay. The booking hub lists the other checks that belong before a deposit.
If you are comparing two quotes and cannot tell who would actually look after you on the ground, send them to us and we will map the chain for each one.
Common questions
Who do I contact first if the promised halal meal is missing?
Contact the seller who took your money, in writing, with the page or message that made the promise. If a guide or hotel is in front of you, ask them to fix the meal on the spot and photograph the situation. Then message the seller the same day, so the record shows you raised it early.
Is the local guide responsible for what the agency promised?
Not directly. The guide carries out the plan they were given. If the plan never mentioned your halal or prayer arrangements, the guide may not know about them. That is why the written promise should reach the local team before you fly, and why you should ask whether it has.
Can I complain to the hotel if the agency booked it?
You can ask the hotel to help in the moment, and a good hotel will try. But your contract is with the seller who booked it for you. A refund or compensation request normally goes to that seller, who then deals with the hotel behind the scenes.
What if the agency says it was the supplier's mistake?
That is an explanation, not an answer. You paid the seller, so ask what the seller will do about it. Keep the request short: the promise, the page it came from, what happened, and the fix you want, such as a refund of the meal portion or a replacement.
Where can I report a seller who may not be licensed?
MOTAC invites the public to report suspected tourism rule violations through its SISPAA complaints system. Keep your messages, receipts and the seller's details ready. Check the MOTAC website for the current address before you file.
